TERMS OF SERVICE

Independent Care

1. Nature of Services

Independent Care provides non-medical, in-home support services designed to assist individuals with daily living needs, companionship, safety oversight, and related supportive care.

Independent Care does not provide medical care, nursing services, diagnosis, treatment, or medication administration unless explicitly stated in a separately licensed service agreement.

Services are intended to support comfort, dignity, independence, and safety within the home environment.

2. Eligibility and Service Agreements

Services are delivered only after:

  • completion of an intake or assessment process

  • confirmation that requested services fall within the non-medical scope

  • execution of a written service agreement

Independent Care reserves the right to decline or discontinue services if:

  • care needs exceed the non-medical scope

  • safety risks cannot be reasonably managed

  • required cooperation or payment terms are not met

In such cases, referrals to appropriate providers may be offered when possible.

3. Scheduling and Availability

Service schedules are based on:

  • caregiver availability

  • geographic coverage

  • client care needs

While every effort is made to maintain consistent scheduling and caregiver continuity, substitutions or adjustments may occur due to illness, emergencies, or operational necessity.

Independent Care will communicate material schedule changes as promptly as possible.

4. Payment and Fees

Service rates, billing structure, and payment timing are defined in the client service agreement.

Failure to meet payment obligations may result in:

  • service pause or termination

  • collection activity as permitted by law

Independent Care aims to maintain transparent and respectful financial communication at all times.

5. Limitation of Liability

Independent Care provides supportive, non-medical services and cannot guarantee:

  • prevention of illness, injury, or medical events

  • outcomes beyond reasonable supportive care

To the fullest extent permitted by law, Independent Care is not liable for indirect, incidental, or consequential damages arising from service use, except where prohibited by applicable law.

Nothing in this section limits rights that cannot legally be waived.

6. Client Responsibilities

Clients and families agree to:

  • provide accurate health and safety information

  • maintain a safe home environment for caregivers

  • communicate schedule or condition changes promptly

  • follow agreed payment terms

A cooperative relationship helps protect safety, dignity, and service reliability.

7. Changes to These Terms

Updated versions will be posted on this website with a revised effective date.
